In January 2025, the Asia-Pacific International Arbitration Court (Malaysia) (hereinafter referred to as ‘APIAC (Malaysia)’) successfully concluded its first arbitration case, and achieved a series of remarkable achievements.

First of all, the case adopts the ‘Invitation Arbitration + Mediation’ mechanism pioneered by APIAC, which provides an efficient solution for the dispute between the two parties to the contract that did not clearly stipulate the arbitration clause in the contract.

Secondly, the case fully demonstrates the multilingual advantage of APIAC (Malaysia). In this case, the applicant is a Malaysian company with Chinese capital, and the respondent is a Malaysian citizen. The two sides, with the assistance of the APIAC (Malaysia) secretariat, mediated in Chinese, Malay and English and other languages, and finally reached a reconciliation. This cross-cultural and multi-language mediation method has played a key role in promoting effective communication and ensured the successful conclusion of the settlement agreement.

    Third, in this case, the arbitration fee is fixed according to the disputed amount, which significantly reduces the economic burden of the parties. This model provides enterprises with a more cost-effective way to resolve disputes.

In the end, the consent decision in this case was issued by the Malaysian International Arbitration Center (APIAC) arbitrator Datuk Jiang Shengfan, to ensure that the agreement reached by both parties after mediation is legally binding on both parties and will be executed quickly.
